New York Car Crash Lawyer Secures $110,000 Settlement for Red Light Violation Accident
A red light violation led to a serious car accident in New York, resulting in severe injuries to our client. The defendant's vehicle ran a red light and T-boned our client's car. An ambulance nearby witnessed the accident, provided immediate medical aid, and documented their observations in the ambulance call report.
As a result of the impact, our client suffered a fractured left thumb and a torn ulnar collateral ligament, both requiring surgery. Due to the pain and suffering endured, our client received a $100,000 policy tender from the defendant.
Following the accident, the insurance adjuster engaged in a pattern of bad faith and frivolous conduct to avoid paying our client the full policy limits. This included dilatory tactics, misrepresentations, and inappropriate commentary. GEICO used the COVID-19 pandemic as an excuse to delay responsibilities, interfere with complaints, and misrepresent their role, even suggesting our client should risk exposure to COVID-19 to receive full compensation.
To address these injustices and prevent similar future occurrences, our client brought a suit against GEICO, seeking compensatory and punitive damages. The lawsuit aimed to secure not only monetary relief but also the implementation or revision of a system to monitor settlement practices. This effort resulted in an additional $10,000 settlement for Intentional Infliction of Emotional Distress.
