New York Slip and Fall Lawyer Obtains $2,500,000 for Client in Negligence Case
Our client, a 47-year-old home health attendant suffered a severe slip and fall injury on a negligently maintained staircase in a Brooklyn, NY, multiple dwelling apartment building. Defendants knew or should have known about the wet stairs that caused her to slip, fall, and sustain severe and permanent injuries while on her way to work in the morning.
The client arrived at the building at 8:20 am, walked up the stairs to her patient's apartment, and encountered dirty brown water covering four of the stairs. Above and below the stairs were wet, dirty shoe prints. Around 9:00 am, she went back down the stairs to retrieve medication for her patient. She noticed the water had become dirtier, and there were more, dirtier footprints.
Notwithstanding, the client believed using the same stairs was the least dangerous way to exit the building at the time. She avoided the back staircase, where young men were hanging out and blocking the pathway, and the elevators, which were not working and posed a safety threat. While descending the stairs, she slipped on the water and fell down approximately half of the staircase. As a result, she was removed from the scene via ambulance.
She sustained significant injuries, including damage to her left side, neck, back, left shoulder, and left knee. She was diagnosed with disc herniations and radiculopathy, resulting in surgeries to her lumbar and cervical spine.
The case was settled on the eve of trial for $2,500,000, holding the negligent parties accountable and ensuring the client would be taken care of for the remainder of her life.
